Our products and services are intended primarily for business and professional use. Nothing in these terms limits rights that cannot lawfully be excluded, including applicable consumer rights.
These website terms do not replace a service agreement, data processing agreement, paid dataset licence, Sample Dataset Evaluation Licence or other agreement governing a particular product or activity.
The applicable specific agreement governs that product or activity and takes precedence over these website terms to the extent of a conflict. Any agreed order of precedence within those agreements continues to apply.
Access to our website does not itself grant a right to use our APIs, software, datasets or samples. Those rights arise only under the applicable agreement or licence.
Where acceptance of specific terms is required, we present them before you complete the relevant request or transaction.
You may access the website and use its general information to learn about DDG and its services. You may save materials expressly made available for download, subject to any accompanying terms.
You must not:
Authorised security testing must stay within its agreed scope. If you discover a potential vulnerability, contact info@duckduckgoose.nl.
Rights in the website’s design, software, branding and protected content belong to DDG or the relevant rights holders.
These terms grant only the permissions expressly stated. You must preserve applicable copyright, provenance and other rights notices.
Our name and logo may not be used in a way that implies endorsement or a commercial relationship without permission. This does not restrict lawful factual references.
Separate licences govern datasets and samples. No claim is made that every AI-generated element necessarily attracts exclusive intellectual property protection.
You retain your rights in material you submit. You must have the authority and lawful basis needed to provide it for the requested purpose.
By submitting material through a general website form, you give DDG permission to receive, store, reproduce and review it only as necessary to handle your request, provide the expressly requested function and meet applicable legal obligations. Service providers may assist us under appropriate restrictions.
These website terms do not grant DDG a general right to publish your material, redistribute it as a dataset, or use it to train or improve AI models.
Uploads to a product, demonstration or testing service are governed by the terms and privacy information presented for that activity and any applicable service or data processing agreement.
Do not send genuine identity documents, sensitive personal information or confidential third-party material through general enquiry forms unless we have agreed a suitable process.
Free samples are subject to the Sample Dataset Evaluation Licence presented during the request process.
These website terms do not extend the permitted purposes, evaluation period or access rights under that licence. Training, production use, redistribution and other uses require the rights specified in the applicable licence.
A sample request does not itself create a paid subscription or obligation to purchase.
Our Privacy Policy explains how we process relevant personal data:
https://www.duckduckgoose.ai/privacy-policy
Acceptance of contractual terms does not constitute consent to optional marketing, cookies or international data transfers.
Newsletter and promotional email subscriptions require a separate opt-in. Necessary communications about a request, access, security or an existing agreement may still be sent without marketing consent.
We take reasonable care in presenting website information, but it may contain errors or become outdated. General website statements, examples, calculators and demonstrations are informational and do not replace commitments expressly made in an applicable agreement.
Unless expressly agreed, we do not guarantee uninterrupted website availability, compatibility with every system or suitability of general website information for a particular purpose.
We may maintain, update or suspend website functions where reasonably necessary. This does not remove obligations under an existing product agreement or licence.
Links to external websites do not imply endorsement. Their content and practices are governed by their own terms and privacy information.
Liability relating to a product, service or dataset is governed by its applicable agreement.
For general website use, and to the extent permitted by law, DDG is not liable for indirect or consequential loss, lost profit, lost revenue or lost business opportunities.
Nothing in these terms excludes or limits liability for fraud, intentional misconduct or deliberate recklessness by DDG or its management, or any liability that cannot lawfully be excluded or limited.
Each party remains responsible for its own acts and omissions under applicable law and must take reasonable steps to limit avoidable loss. These terms do not create an unlimited obligation for website visitors to indemnify DDG.
We may restrict website access where reasonably necessary to address misuse, security threats, infringement or legal requirements. Where practical and appropriate, we will explain the reason.
Restrictions affecting access provided under a separate agreement remain subject to that agreement.
If credentials are issued to you, keep them secure and notify us promptly if you suspect unauthorised use.
We may update these website terms prospectively and will show the latest revision date. Where renewed agreement is legally required, we will obtain it.
A website update does not retrospectively change an accepted dataset licence, service agreement or other separate contract.
If a provision is unenforceable, it will be limited or severed only to the extent necessary. The remaining provisions continue to apply.
These terms govern general website use only. They do not supersede separate agreements concerning our products, services, datasets or the processing of personal data.
Dutch law applies to these website terms, subject to any mandatory protections available under applicable law.
For disputes with business users concerning these website terms, the competent courts in The Hague, The Netherlands have exclusive jurisdiction, subject to mandatory jurisdiction rules.
Any jurisdiction clause in a separate agreement continues to govern disputes under that agreement. Consumers retain any mandatory rights to bring proceedings in another competent court.
